A. Collection and Use of Personal Information
Privacy laws typically define personal information as information about an "identifiable individual", such as name, age, home address and phone number. There are two forms of information captured by the momentem software from your mobile device (collectively described herein as "momentem data") as follows:
Once Redwood collects the momentem data using the momentem software, it gets transmitted via the internet to a dedicated and secure server environment where it is managed by Redwood solely for the purpose of providing the momentem services to you or providing you with administrative notifications, forwarding software updates, sending occasional newsletters, or responding to your inquiries.
Your momentem data, specifically including individual tagged call records, is never viewed, analyzed or used by Redwood for any other purpose, or shared with any third party, except as described elsewhere in this Policy, and is never made visible to any other user of the momentem services. No location-based information is ever stored or sent via the momentem software and services. The momentem software and services do not access any other part of your mobile device to collect any other personal information except for the information you specifically prompt it to tag.
Statistical Analysis of your Personal Data
You should also be aware that we may analyze both kinds of the momentem data described above on an aggregated, non-personalized, statistical basis. We reserve the right to rent, sell or share this aggregated data to third parties for statistical analysis only. We never provide this type of aggregated data to any third party in a form that would allow you to be personally identified, nor is your momentem data used for telemarketing.
B. Disclosure, Data Transfer and Information Sharing
Transmission of the momentem Data
The momentem software uses wireless industry-standard encryption techniques over the wireless radio medium, so the momentem data being sent from your mobile device to the momentem server is as secure as any voice call, text message or web browsing that you do using your mobile device. When we send your momentem data report from our server back to you via your e-mail account, you should be aware that, as with any information sent via your e-mail account, it is unencrypted and may not be secure.
Due to the topology of the internet, and the need for global services like momentem to have redundancy and failover built in, your momentem data may be transferred and maintained in a location outside your state, province, country or other jurisdiction where the privacy laws may not be as protective. By using the momentem software and services, you agree and acknowledge that your momentem data may be transferred outside your country of residence, and processed there.
Personal Data Provided During the Sign-Up Process
As you will have signed up to obtain your copy of the momentem software and subscription for the momentem services via a third party distribution agent, such as your wireless carrier or other retail distribution outlet (a "Distributor"), this Redwood Privacy Policy does not apply to any information that you submit during that sign-up and subscription process. You will need to refer to the privacy policies of your Distributor to find out about their practices regarding the collection, storage and use of any personal information that you submit during the sign-up and subscription process. Redwood is not responsible for the privacy practices of any third party.
Support and Subscription Services
In order to continue to provide you with the momentem services, Redwood and the Distributor may need to share certain information that identifies you solely for the purposes of maintaining your subscription and service account, including your name, e-mail address, mobile telephone number, and some unique identifier generated by either Redwood or the Distributor.
Depending on the business relationship between the Distributor and Redwood, either party may provide you with support. In order to provide you with such support, the parties may be required to provide each other with a minimal amount of your personal information as is necessary to register and respond to your support query.
Redwood Never Shares Data from the Call-Tagging Process
Redwood never shares the information regarding your tagged Events or usage patterns (except on an aggregated, non-personalized, statistical basis as described above), with any third party, including any Distributor. In those instances where we need to share information that identifies you personally for the purpose of being able to continue to supply you with the momentem services, we are committed to sharing only the minimum amount of your personal information as needed by that third party in order to maintain your subscription.
Third Party Service Providers
We may also retain the services of third party service providers who perform certain functions on Redwood's behalf. These third party service providers are required to sign confidentiality agreements with Redwood and are only provided with access to the momentem data on a "need-to-know basis" as required to perform the services on behalf of Redwood in accordance with this Policy.
Legal Proceedings
Finally, we may also be required to share your momentem data as necessary to respond to court orders or other legal processes or to establish Redwood's legal rights, defend against legal claims, or as otherwise required to comply with applicable laws and regulations.
We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Redwood's End-User Terms and Conditions of Use, or as otherwise required by law.
The Redwood Website
Redwood's website is purely to provide you with access to information about our product and how to access support for using the momentem software and related service. If you choose to contact Redwood via the Redwood website, you will be requested to provide personal information in order for us to respond to your inquiry. Once again, our policies that apply with respect to the momentem data also apply to any personal information that you provide to us via our website.
Redwood is not responsible for the practices of any third party website that may be linked to our website. If you visit a third party website via a link from Redwood's website, you will need to refer to the privacy policies of the third party website provider.
On our website, you are given the option to subscribe to our newsletters and other communications regarding new products and services. If at any time you choose not to receive these communications, you can unsubscribe for them as directed on the applicable webpage or e-mail communication.
Redwood reserves the right to use "cookies", industry-standard technology in the form of a small amount of data, which often includes an anonymous unique identifier that is sent to your internet browser from a web site's computers and stored on your computer's hard drive.

E-mail Communications from Redwood
When we send e-mails to you at the e-mail account you designate during the registration process, we use industry-standard techniques such as requesting delivery receipts and read receipts, and within those e-mails you have the option of downloading and viewing the images which are stored on a server and the option of clicking hypertext links to access further information on the internet. You should be aware that these techniques, which are used within almost all marketing e-mails that you receive from service providers, such as airlines, loyalty cards, newsletters and retailers, provide us with information about your e-mail viewing habits. Redwood only uses this information in order to provide the momentem services to you, and does not share it with any third party.
C. "Opting out/Opting in"
Before you first start using the momentem software, you are required to accept the terms of this Privacy Policy and Redwood's End-User Terms and Conditions of Use for the momentemsoftware and services. If you change your mind and decide that you want to discontinue using the momentem software and services, you can de-register or uninstall the software from your mobile device and you must notify Redwood and your Distributor in writing that you wish to deactivate your subscription, at which point all of your registration information and momentem data will removed from the Redwood systems in accordance with industry-standard data purging techniques.
D. Access to your Personal Information
If you have any questions about the collection, use or disclosure of your personal information by Redwood, or, if you simply want to know whether Redwood has any of your personal information on file, you may contact us via the Redwood website www.redwoodtechnologies.com and we will put you in touch with our compliance officer.
Except in limited circumstances, as specifically set out in applicable privacy legislation, a representative of Redwood can tell you what personal information has been collected and stored, allow you access to your personal information, and find an account of the use that has been made or is being made of the information and the third parties to whom it has been disclosed.
E. Security of Personal Information
Access to your personal information is limited to our employees and contractors and third party service providers under confidentiality agreements, who we reasonably believe will require access to your personal information in order to provide the momentem services to you. We have industry-standard security policies and practices in place with respect to the management, storage, processing and purging of the momentem data.
F. Changes to our Policy
Redwood may amend this Policy at any time by updating and posting an amended Policy in place of the old one. Redwood will place the amendments on a prominent place on our website. In addition Redwood will endeavour to notify all existing subscribers by sending an e-mail notification to the subscriber's registered e-mail address. The amended Policy will automatically be effective upon posting on our website. Your continued use of the momentem software and services, following the posting of the amended Policy and e-mail notification, shall mean that you accept the terms of the Policy, as amended. If you do not agree with any of the terms in the amended document then you shall discontinue your use of the momentem software and services, which shall be your sole remedy.
